Subrent

Part of speech: verb, noun

Definitions

  1. To lease or rent property from a tenant who holds the original lease rather than directly from the landlord; to enter into a rental agreement for a portion or all of leased premises; to transfer tenancy rights temporarily to a third party under a primary lease
  2. The act of obtaining a property rental from someone who leases it themselves instead of the owner; making an agreement for exclusive use of leased property from the original tenant; temporarily assigning lease rights to another party while maintaining the original lease terms
  3. Engaging in renting a property from an existing tenant; securing possession of leased property through the tenant rather than the landlord; contracting out leasehold rights to another person during the rental period

Etymology: Subrent is a plain compound: the prefix "sub-", meaning "under" or "beneath," attached to "rent," the familiar word for a payment made to use land or property. Together they describe a tenant who holds an arrangement beneath an existing lease, paying rent to the person who holds the main tenancy rather than to the landlord. A sublet works the same way, and the verb is simply the act of making that arrangement. The logic is visible in the structure itself. The original lease sits on top, and the subrent sits underneath it, so the subtenant's rights depend entirely on the primary agreement. If the head tenant's lease ends, the subtenant's position usually ends with it.
